My name is Nikolay Eskin. I was commissioned as Notary Public in British Columbia in May 2012 after graduating from Master of Arts in Applied Legal Studies program at Simon Fraser University. Prior to becoming a Notary Public I gained valuable experience as a licensed immigration consultant. And before that I worked for nine years as a Realtor in Vancouver helping clients buying and selling their homes. Becoming a Notary was a logical next step for me. The profession of a notary existed for millennia. Some say that the first notaries were employed by the ancient Babylonian King Hammurabi in 18th century BCE. The notarial tradition in this province is more recent, the Society of Notaries Public of British Columbia was established in 1926. Unlike notaries public in most other English-speaking provinces and states in North America (the exceptions being Québec, Louisiana and Puerto Rico), the tradition of British Columbia Notaries has its roots in the scrivener tradition of England where notaries enjoy high legal standing.

In British Columbia, when acting for a client in a real estate purchase or sale, a Notary Public has the same duty to the client as a lawyer. All real estate transactions are registered at the office of Land Title and Survey Authority of B.C. and they are equally legal, whether the registration was done by a Notary Public or by a lawyer.
Real EstateProperly executed Will drafted by a Notary Public will have the same force and effect as a Will prepared by a lawyer. There are certain Wills however that BC Notaries cannot draft and must refer clients to a lawyer. Those Wills usually involve the need to create trusts for adults. Your Notary will be able to advise you on whether the Will you wish to draft requires the services of a lawyer.
Estate PlanningWhen you sell your condo, you have to give to the buyer clear title to your property upon completion. If you have a mortgage on title, without a Notary Public or a lawyer this becomes problematic.
The bank will not provide a mortgage release to the seller until it receives full amount of the loan owing, and the seller cannot pay out the full amount of the loan to the bank until he/she receives the sale proceeds from the buyer. Your Notary Public gives a solemn guarantee (called “undertaking”) to your bank that the bank will receive the loan owing in exchange for its promise to clear off the mortgage from title. The Notary also gives the undertaking to the Notary or lawyer acting for the buyer of your condo that they will receive clear title to the property upon completion. These undertakings are accepted and the sale completes to the satisfaction of all parties.
