• Perform title search;
• Discuss with you the charges that will remain on title
• Present to you a copy of the Subdivision Plan (for single-family houses) or Strata Plan (for strata properties) as filed in the Land Title Office;
• Obtain and review municipal tax information specific to the property;
• Prepare or obtain transfer and mortgage documents as well as supporting documents required by the LTSA, the lenders or other offices;
• Attend to or arrange for the execution of transfer and mortgage documents;
• Negotiate appropriate closing undertakings with solicitor/notary acting for the Seller;
• Receive and account for trust funds;
• Provide your lender(s) with the requested security documents;
• Attend to the registration of relevant documents at the appropriate Land Title Office;
• Make inquiries as to the residency status of the Seller pursuant to the Income Tax Act as required;
• Disburse trust funds;
• Report and provide you with a final State of Title Certificate.

• No work has been done to the property which may give rise to a Builders' Lien or claim, or if there have been repairs or alterations, that appropriate steps have been taken to ensure that no claim is outstanding. We will, of course, do the usual pre-index search at the Land Title Office prior to registering the Transfer to ensure that there are no outstanding registered Builders' Liens;
• The property is appropriately zoned for any particular use you may wish to make of it and that the property is not the subject of anticipated expropriation or municipal or other work orders (this information may be obtained from the Municipality);
• The water supply is potable and adequate and that the condition and capacity of any septic tank on the property is acceptable;
• There is legal access to the property;
• You have arranged for the connection of any utility services which you require such as electricity, natural gas, telephone or Internet;
• Satisfactory arrangements have been made for delivery of actual possession of the property, particularly if there are presently any tenants in occupation. You should arrange with your realtor for the delivery of keys on the possession date;
• Satisfactory fire, flood & earthquake insurance of the property has been arranged to be in place no later than 12:01 a.m. on the completion date showing loss payable to your lender (if you have a mortgage);
• You have made any required or necessary investigations and/or searches concerning the Heritage Conservation Act to determine if there have been any heritage and/or archaeological sites (i.e. First Nations burial grounds, etc.) identified on the property;
• That you have made all necessary or required inquiries as to the inhabitability or condition of any of the buildings located on the Property;
• You have obtained a survey certificate to ascertain the property’s dimensions and to confirm that the buildings and/or fences, landscaping, etc. are entirely within its boundaries and not encroaching on easements or rights of way and that all buildings are in compliance with municipal bylaws;
• Any required fire permit for wood-burning stove (if applicable) has been issued and received by you from the sellers.

Sale

The scope of my work on your purchase includes the following services:

• Review the fully executed Contract of Purchase and Sale provided to us by you or your realtor;
• Search the title of the property;
• Identify and confirm with you the charges that are your responsibility to pay out and discharge;
• Request payout statements from the identified lenders;
• Review payout statements upon their receipt from the lenders;
• Receive, review and revise, as necessary, the sale documents from the buyer’s solicitor/notary;
• Prepare supporting documents;
• Attend to or arrange for execution of sale and supporting documents;
• Negotiate appropriate closing undertakings with solicitor/notary acting for the buyer;
• Provide your lenders with payout proceeds and discharge forms;
• Receive, account for and disburse trust funds;
• Register discharges received from the lenders at the appropriate Land Title Office;
• Report to you and to the Buyer’s solicitor.

Prior to the completion of your sale you should satisfy yourself with respect to the following items which normally are not part of my services:

• Holdback of funds for any purpose, whether you have agreed to a holdback in the contract or not (including but not limited to potential future strata assessments, builders liens, deficiencies, etc.);
• Payment of unpaid property taxes or strata maintenance assessments or arrears;
• Payment and discharge of registered builders liens, judgments, family maintenance enforcement charges, or any charge other than a registered mortgage charge;
• Payments to Canada Revenue Agency (“CRA”) of any nature and at any time in connection with the sale of the property;
• Payments to the provincial Ministry of Finance of British Columbia of any nature, including payouts made under any Land Tax Deferment Agreements;
• Analysis or advice regarding tax implications. You should seek professional advice from a chartered accountant or a tax lawyer if you are concerned about Good and Services Tax, income tax, non-resident tax, or any tax that may affect you or others with respect to this transaction;
• Making changes to the Contract, including drafting Addendums to the Contract of Purchase and Sale regarding extensions of time for completion;
• Escrow closing arrangements;
• Investigation as to the truth or accuracy of any representations or warranties as contained the Contract of Purchase and Sale. We will assume that the Contract of Purchase and Sale represents the entire agreement between you and the buyer with respect to the sale of the Property;
• Any other agreements not contemplated in the Contract of Purchase and Sale as executed and presented.
